Samsung allowed to sell its new Galaxy tablet in the U.S.

The Justice U.S. lifted Monday evening 1 st October, a temporary ban on sales to the United States to the Galaxy Tab 10.1, Samsung Electronics, which had been imposed prior to the trial that pitted the southern group in August- Korean Apple .Even if the model in question is not the most recent lifting of the ban on the sale comes as the looming holiday season, the key moment for manufacturers of electronic products. Judge Lucy Koh , the court of San Jos é, California, found that the Galaxy Tab 10.1 does not infringe patents on design grounds that had motivated its prohibition. "the basic order of 26 June n longer exists and the court considers it appropriate to end " , prompted Judge Koh on Monday in his judgment.

A TRIAL COASTER
"We are pleased with the court's decision, which confirms our position that there has never been a violation of Apple patents (...)" , said Samsung in a statement. The South Korean group has also filed a complaint, saying that the iPhone 5, the latest smartphone from Apple violated some of its patents. Lucy Koh chairs a large trial on patent infringement that Apple opposes Samsung. In August, Apple won a significant victory over Samsung in the United States, a California jury recognized the South Korean group guilty of having copied Apple products and recommending him inflict a fine of more than one billion . In mid-September, Apple has asked more than 700 million in additional damages while Samsung has requested a new trial. The Californian group believes that the damages received do not cover enough offenses Patents knowingly Samsung. Judge Koh has scheduled a hearing on December 6 to discuss the exact amount of the fine, which could be tripled, and bans the sale of certain Samsung products as a result of judgment in mid-August.

INTERNATIONAL LEGAL BATTLE
Samsung believes his side of the court that the constraints on the timing of the trial - the evidence of witnesses and documents were unprecedented for a patent litigation of this magnitude and complexity - was unable to present a full and fair response to numerous accusations of Apple. As a result, the South Korean group wants a new trial. In addition to the trial in California, other legal proceedings are underway in several countries, including the Germany, the Australian or the Japanese. In the latter country, Samsung has been cleared of any violation of Apple patents. Apple is the world's number one digital tablets before the South Korean, ahead instead the U.S. for sales of smartphones.
